My ex husband just got out of prison, for armed robbery,a month and a half ago. He had been in close to 6 years. My oldest was only 10 months when he went in and I was 5 months pregnant with the other. Needless to say they don't know him and have somebody who has been in there lives for the past 3 1/2 years, who they call and think of as daddy. I would much prefer that my ex just sign over his rights. But my question is what are my rights if he does try for custody or shared custody? What should do and expect?

Murderers, rapists, arsonists, even child molesters are allowed to mommies and daddies.

That said, children aren't chattel, and can't just be given away or owned.

He can seek a visitation arrangement via court order.

As you indicate he is your former spouse, did your divorce decree address custody? No need to answer, you need to know, not me.

If your divorce failed to address custody, he might seek some form of court order. If he does, all you can do is seek supervised visits, until the kids get to know him.

Eventually, if he's persistent, he'll get to be daddy his way. Just like you get to be mommy, your way.

Don't worry about stuff that hasn't happened. Nothing you can do to stop others from exercising their rights, except defend yours.

These ex-felons will often reoffend and return to their prison homes. Just live your life, and don't fear what you don't know.
