I leased an apartment that my sister co-signed for. I moved out before the lease was up. I'm a server in a restaurant and due to the economy, business fell off (they ended up closing), and I wasn't making enough to pay the rent. I had an eviction notice, so moved before my belongings were thrown out on the street.
Long story short, I owe two thousand dollars on this apartment. A collection agency is handling it and they are very rude. My sister has excellent credit, and they are harassing her to the point of calling her job. I've tried talking to them, to make arrangements to make monthly payments. They tell me the balance must be paid in full, NOW, or they will make my sister responsible since she co-signed. Her credit will be ruined, and she is very upset with me.
I want to know what the law is concerning collecting a debt. I made the debt, but I'm still out of work and there is no way to pay this in a lump sum.
Can they refuse to take monthly payments of one hundred dollars? If I make the payments, on the same date each month, can they tarnish my sister's credit? And can they be rude on the phone, to either of us. They won't let us speak, just demand the payment in full. They have even hung up on both of us.
I'm sick over this. My sister did me a big favor, and now she is so upset with me. What can I do to stop this company from harassing my sister?
