Falsely representing self to officer...NOT GUILTY& IN CUSTODY


I was pulled over for a traffic violation. I was with my boy-friend & his friend. They are both on parole and were under the impression that they were in violation of there parole by being together. So his friend hide his I.D. and wrote down false name and info. when officer asked him to. My boy-friend was then handed the officers note book and asked to also write his info. My boy-friend was standing right next to me and I saw him write the first couple letters down that weren't his name so I told him not to lie. The officer then asked him why he needed my help to write his info. and he looked at the cop and told him, " I'm gonna be honest from the start and I was gonna give you a fake name but I choose not to do so after all" then the cop answered him by telling him that he made the right choice because he had the last word on how things went for us in the next few minutes. Then the cop went on saying how if we were honest with him and had something pending with the courts or anything, that it would be totally up to him whether he arrested us or not. And that he would take our honesty accountable. So he crossed off what my boy-friend started to write and said he was gonna pretend he never even wrote that and give him a chance to write his info. And my boy-friend did so. He wrote all of his correct info. and the officer ran them both and everything came back clean. Then another officer found the friends I.D. and discovered he wasn't who he said he was. So okay I can understand why he was arrested. But he arrested both of them. And claimed they both gave false identities. My boy-friend already went to court and plead NOT-GUILTY and didn't accept the offer they gave him of 60 days. So he remains in custody. His parole officer already went to see him and advised him that he wasn't gonna violate him and release the parole hold. He goes to court on Friday March 6th. Were trying to figure out if I should get a lawyer or if there just gonna end up dropping the charges. Or worst case he pleas GUILTY and takes the offer plus his time served since Feb.19th 2009. WHAT SHOULD I DO?????PLEASE HELP ANY INFO.S GOOD THANKS

Yes, he definitely needs a lawyer.

why do YOU need a lawyer?? I thought HE was the one who was arrested?

His lawyer might be able to make a deal with the DA if the officer agrees as to the events. If parole is not going to violate him, then the DA might decide to drop the matter as well. His attorney will have to look into the matter. If he cannot afford one, an attorney should be appointed for him.

On a side note, it's bad enough having a parolee boyfriend, but even worse when the parolee boyfriend is kicking it with another parolee ... who then lies about his identity! Your boyfriend needs to change his associations or he will spend a great deal more time in custody. When cops see two parolees together, they automatically assume that something's up. And, quite honestly, they are usually up to something not quite lawful when together. encourage him to get new friends.

I agree with you 100% and if that's not something he's willing to do then I think I will just find me a new boy-friend...Thank you for your input! And hiring a lawyer would be for him not me. I feel like he's innocent and is spending time in jail for nothing....
