my IDIOT of a boyfriend stole a phone from AT&T and got caught and now im wondering, i know the max sentence but im wondering what is most likely going to happen to him, he has one prior felony for something complely different that is 12 years old. i guess its a 3rd degree felony. is it possible that he will get something other then jail time seeing as how we have a new baby and im still looking for a job so hes the only breadwinner at this time...

I suspect he will see some jail time. What state was this in? He is still on probation for his felony charge?

That depends on whether he has been charged with a misdemeanor or a felony. And, of course, the state he is in.

Okay ... so, if he has been charged with a third degree felony it appears that the value of the stolen items were $300 or more, or, he used some form of anti-shoplifting or inventory control device countermeasure.pepto1014 said:

I suspect that SOME jail time is in his near future, but could not venture a guess as to just how much that might be. He needs to consult an attorney ASAP.
