Shoplifting, Larceny, Robbery, Theft need advice on retail theft 300+

my IDIOT of a boyfriend stole a phone from AT&T and got caught and now im wondering, i know the max sentence but im wondering what is most likely going to happen to him, he has one prior felony for something complely different that is 12 years old. i guess its a 3rd degree felony. is it possible that he will get something other then jail time seeing as how we have a new baby and im still looking for a job so hes the only breadwinner at this time...
 
That depends on whether he has been charged with a misdemeanor or a felony. And, of course, the state he is in.

Do you know the code section he has been charged with?

i dont sorry. i know its a 3rd degree felony. hes not on probation. the other charge was 12 years old. and we live in the state of florida

Okay ... so, if he has been charged with a third degree felony it appears that the value of the stolen items were $300 or more, or, he used some form of anti-shoplifting or inventory control device countermeasure.

If he has a prior, this will be a second offense. I am uncertain as to whether there is an enhancement under FL law for that prior offense, but I would not be surprised if there were.

I suspect that SOME jail time is in his near future, but could not venture a guess as to just how much that might be. He needs to consult an attorney ASAP.

I'd find a new breadwinner, one that think about his girlfriend and kid and not a free cell phone.
