I would like to know if you do not have a written agreement/lease for renting a property, can the landlord go through with the eviction process? We had planned to buy the property, but things fell through and we've been renting for 3 years. Our lease was up in Dec and we only communicated verbally, nothing else was ever wrote up. Now, they have sold they house and we have to move and I'd like to know if we do not pay, can they evict us??? We dont want an eviction on our credit report, but do not feel this is right.
 
I don't believe eviction goes on your credit report but the non-payment of rent would he if submits/reports it. The landlord does have the right to start an eviction process especially if you're not paying rent. Why do you feel you don't have to pay rent or why do you not want to pay the rent? If you are living there you are required to pay rent despite the fact your lease was up. Did he give you notice and you stayed beyond the notice date AND didn't pay rent? Check your lease and maybe it automatically rolls over for the next year. Also, google landlord tenet laws for your state. That will tell you your rights and the landlord's rights.
 
No, we never got notice (we were going to buy), and it doesn't roll over. we've always paid on time, despite the fact that when we call to let them know something is wrong or needs to be fixed, noone ever shows and no we didn't pay this months rent because we were dealing with their (landlord) mortgage company and getting everything paid (as far as credit) so that we could buy the house and they said "everything's looking great, we should be able to go through with things shortly" and then we find out they've sold the house and we had to move by December (they were giving us time to save and find somewhere) then a week later we get a call saying we had to leave in 30 days because they had a buyer. Now that we're leaving they have different people coming by fixing this and that. I feel they knew we wouldn't be able to get the house, but wanted us to think we could so we'd stay and pay then they'd sell it to someone else and make even more because had we known we wouldn't get the house we would have moved a LONG time ago. Am I the only one who thinks this is wrong?

To answer your question, if you do not pay rent while living there, YES they CAN evict you. It will result in a public record action on your records as well as a monetary judgment that can be recorded as a lien against any future assets, be put on your credit report AND prevent you from being able to find another rental.

Unless you had exclusive right to buy in writing and even then if you couldn't qualify...your LL would then be free to sell to someone else.

Not sure exactly what your question is..almost sounds like a threat to not pay rent because you are upset that YOU did not qualify for/get the house...NOT a good idea. With an eviction on your record you might never be able to buy a house.
 
Hmm, I take by the name your a landlord yourself. Not to sound mean, but it figures Id get that response from you. No, its not me upset because we didnt qualify, its me upset because they told us we did and led us to believe we would be buying, not someone else.
 
It is not the LL's responsibility to analyze your credit/financial situation to purchase OR find a mortgage lender for you..that is YOUR responsibility..if you don't qualify for the loan, I don't see how this is the LL's fault.

LL or not I DID answer your question(s)..re: paying rent, eviction, etc.
 
Yes, you did answer my question and I do thank you for that. No, it isn't their responsibility to do anything, but when the LLs husband works for a mortgage company and "knows someone who deals with credit management" and they get paid and we hear on a monthly basis "things are looking great", it tends to look misleading when it all falls apart. I think we were just naive to how things work in the real estate business.
