Court order states that my ex is to be primarly responsible for all dental care. well recently I took my daughter to the dentist who then referred me to an Orthodontist office. They didnt accept the fathers insurance which i didnt know since I was being referred to them. So I paid the cost which was 265.00 out of pocket. The father is now trying to claim that on his insurance . Can he do that since his insurance was not used.

Did he reimburse you for it? If so, he is out $265 and can try to claim it on his insurance. If not, he hasn't paid anything, and has nothing to claim against his insurance company.
