In December of 2006 I signed a lease for a 2 bedroom townhouse. February of 2007, I lost my job and was able to get unemployment. The short of it after that is by July/August of 2007 I still had not found employment, and the little money I was getting for NYS Unemployment Benefits wasn't enough. I was summoned to court for late fees on my rent and in the month of August also being a week late. Upon going to court, I told the attorney for the rental property my situation and we agreed I would be out by the end of the month (approximately 2 weeks later). As for what I owed, it was still undetermined because I technically could have got stuck with the rest of the lease through November. His words were "Get back on your feet and give me a call as soon as you do so we can figure this out and make arrangements".
It's now January 2008 and I still have no fulltime employment. I do work part time but it's VERY part time. I'm staying with a friend, and receiving help from my parents on my car loan/insurance (in my moms name no less), etc. I'm about to move back in with her temporarily in a week or so until I do get back on my feet.
My reason for this post is because she (my mother) recently received a letter supoena for information on me. It asks general stuff, but also my current residence, job situation, what I'm driving (and in who's name), and also lists the total amount of what I owe. It is not signed by a judge, it's just a letter from the attorneys office. I called them today (I should have sooner but haven't because I'm not "back on my feet" at all) and the lady who answered the phone was less than helpful or pleasant to speak with. My question is this...:
Is this something my mother HAS to fill out? If so, how can they list my balance on something sent to her (I didn't even know my balance) and what grounds do they have to even contact her about anything? The lease was soley in my name, and I'm 26 years old so she's not legally responsible for me. Can they do this? It really ticks me off that they are to begin with. The only thing I can think of is there were a few times I gave her cash and she wrote a check for me which I handed in for rent. It beat doing a money order when I closed my bank account and still had to pay rent.
