Hello
Looking to help a friend.
Land owner died with no will or executor appointed.
He did have a live-in girlfriend for twenty five years but were never married.
She owned the trailer they lived in, but was told she had no rights to the property.
He owed two years back taxes and has approximately $100,000.00 in hospital bills that will not be paid by Medicare.
The only asset he has is the land, there is no house on the property.

1) He has three children, will one or all of them take possession of the property?

2) Will the child that takes possession of the property also be responsible for the Hospital debt?

3) If the property is signed over to the girlfriend will she be responsible for the Hospital debt?

4) If the property is sold to a non-relative will they be responsible for the Hospital debt?

Depending on the value of the property, there may be nothing left to distribute, sell, or sign over after the probate process.

The back taxes and medical bills will be paid before any assets are distributed to the heirs.
 
The land is only worth around $6000.00 which will not pay the complete debt.
If the land is sold at the tax auction for back taxes will the person that purchases the land be responsible for hospital debt.

No one has any liability for the medical debts of the deceased.

The land has nothing to do with the hospital debt.

The children (all three) stand to inherit the land. However, the land is subject seizure for back taxes.

If the land is seized for back taxes, the purchaser of that land at a sheriff's sale, will not have to worry about the hospital debt of the deceased.
