Shoplifting, Larceny, Robbery, Theft need answers please!!!!

My son whent to a well known retail store with some friends.while in the store my son and his friends were looking at some video games. the people he was with whent to get on line to check out while my son was still at the electronics area he was then joined by another young man that did not travel in the same car nor did my son know he was comming to the store . my son proceeded out side to wait for his ride that was checking out on line. the other young man that came in a seperate vehicle followed my son out side. the store worker then came out side and told my son and the other young man to go back in side because they had reson to beleive that property had been stolen. when they got to the back room the other young man took of running and my son went in the back room with them and cooperated with them. they searched him and found nothing on him they searched the video and saw him take nothing they then released him to his mother that same night I guess because he is a minor. this was in december, we got a letter stating that there was a complaint filed against him for shoplifting and that he is to appear in court for a deposition. If they found nothing on him nothing in the video and he was not traveling with the atual person that was caught shoplifting, does he have a case or are we gonna have to hire a lawyer also is there a possible cival suit if he is proven innocent

Yes you will ned a Lawyer to fight this charge. However without intending to be rude I want to say something. Its possible your son has not told you the entire truth. Your right there would be no reason to charge him if his story was true. Regardless has his Lawyer seek the video etc through discovery process.
