need help please with custody question

last year my ex wife and i came up with an agreement that she get my son and i get my daughter. just like every other time we come to an agreement about something she tells her lawyer to stop working and finds a new lawyer to drag this out longer and longer, this has been going on since 2007. Up until just a few days ago she barely calls or speaks to my daughter now all of a sudden she calls two or three times a day and is constantly asking her not me and my wife to come up and stay the summer with her. my daughter is currently in summer school as she is autistic and is also cheerleading. we planned on going to orlando for the for the fourth of july and she told her in a nasty way that yea right she isnt going anywhere and was so nasty that my daughter was crying. a few weeks ago child services shows up at our door because my ex wife and her grandfather were abusing my son. with my concerns and with everything thats gone on is this agreement a legally binding document since it has never gone to final hearing? what can i do about this?

No, your agreement is not binding. Either of you can change your mind at any time and neither of you is obligated to oblige the others request. Nobody can enforce the agreement either. You need to obtain a custody/visitation order.
