I entered into a roommate living agreement with an old friend of mine in May. We've had plenty of problems the first being that we got a three bedroom apt before we had a third roommate. After a month or two he quit showing up to our apartment all together, even though I had found a free kitten for him. From this point on I'm having to track him down for bills because the power and cable are both in my name (the landlord pays water) and make sure he pays rent. As of the end of August he owed me $383 in bills, we still have cable coming. I'm guessing that before his time is up he will owe me $500.

I talked to my landlord today and asked him if my roommate had ever paid him the last months rent, the answer was no, and according to my landlord that debt is on both of us. With the $400 my roommates debt is up to $900. I'm going to get a copy of the lease and read over it before I pay my landlord my roommates rent to make sure that I can be held accountable.

Here is my question. Even though he wasn't living in the apartment of his own accord is he still responsible for power and cable? Also what kind of documents will I need in court, because he always paid me in cash, which I deposited into my bank account. I have saved e-mails with correspondence where he admits that he does owe these things, because he asked me to turn the cable and internet off, and I said no because he agreed to pay them and I live there and they are there for him to use as well, he responded with "thats fine it will just take me longer to pay you back." Also are there any other previous cases that I should be aware of to cite?

I know these are alot of questions and I've gone into a bit of history here, but I just want to try and be as specific as possible.

Thanks for your help!

(1) Do you have a written lease? If so, it makes this case easy as if he's on it then he owes.

(2) If you have a verbal agreement and he lived in the apartment, then you still probably have a case although it may not be as easy to prove.

(3) If you take him to small claims court, I wonder whether he'll even show up.

The bottom line is that you're responsible for everything, unfortunately, and your remedy is to recover it from your deadbeat ex-roommate. Good luck.
