Alcohol & Drugs: MIP, MIC, Intoxication need help

I know someone who has been abusing prescription drugs. We were recently told that the doctor was going to be contacted about the meds. They do not know who has been abusing the meds but I do. My questions are, if there is an investigation, will this person go to jail? And could this person avoid jail by going to rehab?

Was there a crime (besides taking the presc. drugs that were not his/hers) commited? I would keep my mouth shut and get a lawyer if the law ask anything!
