I am in a 12 month lease. When I signed the lease I had a lot of OT from my job that made it ok to move into my current home without any problem. Since then my job has cut OT out completely. I cannot afford my place any longer and I think that I may have found a way out of the lease. I just received a note on my door that in a recent file audit they found that they never had verification of income. I am supposed to make 3x the monthly rent. I do not make that and never have without OT. Can this be used to get out of the lease? I asked the office a little bit about it and they said that it would have been fraud on my part and they would have to evict me...which i assume would come along with massive fees, penalties, etc.

Nice try but nope; sorry; this is not a way to get out of your lease legally.

Your best bet is to see if you can 1. either find a roommate to help with the expenses or 2. see if you can find someone who will sublet the unit.

The lease stands but you can be forthcoming to the management office and tell them that you, at the time of the signing of the lease, were making enough to meet the requirements but since there has been a change in your compensation status, you no longer will be able to meet the requirements and cannot afford the rent. See if they are willing to negotiate with you the early lease break penalty fee and for the months still left on your lease. If none of that happens, all you can do is pay them and move out.

I was thinking that the lease would have never been completed without that. I mean they really never checked my income. Oh well...and what if I just up and leave? What happens then?

You will get a dark spot on your credit report and the landlord will obviously send the remaining balance to collections so they can recover the amount you didn't pay (trust me, you don't want that to happen since it will practically cost you more once they add all the fees they are entitle to add)
