Need Serious Help!

First let me thank you in advance for any advice you may give to me.

Let me start by telling you my story. I have a few collections on my credit report that I recently started paying off. I decided to make 2010 the year to clear my credit up (or at least start). I printed my credit reports and started contacting all the companies via mail and I have managed to get all but one cleared up.

I am currently dealing with a particularly tricky collection agency. This agency is hitting my credit every month with derogatory information and I want it paid if nothing else to prevent further damage. I received a letter on 2/26 regarding a settlement and I immediately sent them a debt validation letter. They signed for the letter on 3/5 and I have proof of delivery via return receipt. Today I received a letter from them dated 3/31 that stated they were sending information that would validate the debt. All I received was a transaction history list with nothing more than transaction amounts. No where on this list is there a running balance nor is there a total. They didn't send any information regarding the purchase date of this account, a statement of ownership and they didn't even send proof of a legit statement from the original creditor.

I had a hard time tracking this account down to begin with. First off, there is no OC on my credit report pertaining to this account. I tracked it down via my TU and contacted them regarding this account. The date on the paper from the CA was 06 and the credit card company didn't even have a record of this account.

I have kept every contact letter with the supposed OC and the CA. I want to get this dealt with in the best way possible but I am at a loss as to whether I should send another letter to the CA and attempt to get further validation or if I should dispute with the CRA.

Another thing about this account--I disputed it with Equifax in March. Three days into the dispute the CA verified the account and yet they sent me nothing more than a transaction history. Is this a violation of the FDCPA or FCRA?

I am at my wits end and I need advice!

If the original creditor won't take your payments, the debt has been written off.

You no longer owe the debt.

What would you suggest I do? I really need this gone, I don't want to pay them, I just can't afford to keep having them hit my credit every month.

Should I send another debt validation letter? I was told by a few other people that I should send another DV letter and then file with the FTC, BBB of San Diego and AG of Cali.

What would you recommend?

I have also read that they are in violation because they are listing as a factoring company and also that this account is listed as open.
 
Those monsters are worse than drug dealers or loan sharks.
They break arms and legs in other, more clever ways.

Indiana has limited homestead exemption help.

Your payments are not going to the original creditor?
That debt has long ago been written off by the original creditor.
These are scavengers.
You could pay them every bit of their tribute they demand, and your credit rating wouldn't improve one iota.
The only way for charged off debts to clear, is to age off.
You are caught in one of the oldest, legal scams there is.
The only one older is taxes!

They say you owe $300.
You finally pay them $300, and then they say you owe $600.
Then you eventually pay $600, then they say you owe $1,200.
It'll never end, until they get the entire debt.
The dirtiest part of this scam is, they bought old paper.
They paid about two to ten cents on every dollar you allegedly owed, maybe less.
They try to maximize that 97% discounted purchase into a 3,300% profit!

The original creditor has long ago written that debt off their books and taxes.
They also made a few cents on selling these scavengers old, useless paper.

Bankruptcy will do more to help you, than stressing and straining to pay these scammers.
As you have observed and experienced, they tell you one amount, and keep raising the bar.
They will suck your blood as long as you allow them to drain you!

You might want to consider bankruptcy.
Otherwise, they'll keep raising the bar on you.
Investigate all your options.

Personally I would file suit against them stating that you do not owe the debt and that they are wrongfully posting information to your credit report. They will never appear in court and you will win a default judgment. Send that judgment to the Credit bureau and they will remove your debt.
 
You can also make a dispute directly with the credit agencies. The credit company will have to provide validation of the debt to them in order to disprove your dispute.
