There are several issues at my wifes workplace and we both feel that she's being treated unfairly and are unsure of where to take the issue... She was hired into a mobile opticians office that goes to nursing homes... she was originally hired to work inside the office. The company decided to incorporate and she was given an ultimatum - either go on the road or leave... she explained to them that we were trying to have a baby and that going on the road wouldn't be feasible after a period of time and she was told not to worry about it. She also explained to them that she was going to breastfeed and that she wouldn't be able to pump or feed if on the road. Again, no problem from the employer... She went out on the road up to her 8th month in which she came back into the office. We had our beautiful baby girl in September... upon returning after her leave, there was an employee that was hired solely for mobile doing that job and she was brought back into the office and was aware that she would go out mobile every now and then. Since getting back to the office she has had several issues with another employee and has made those issues aware to the management staff including the HR management and nothing has been done. The office use to be a light hearted place and there is a lot of joking and playing around... one day this other associate partaked in the joking and proceded to call the HR manager on my wife because she felt she was being picked on... my wife spoke to the HR manager and explained that everyone was involved and having fun and the Manager told her to just not joke around this employee then... Following the Manager's advice, she stopped joking around with this employee and then the Employee calls the HR manager again complaining that my wife doesn't include her... again my wife gets a call and is told that she needs to try to include her in the conversations my wife brought up the fact that she was just told not to do so... this happens frequently back and forth. The bigger issue there are 2 doctors that go mobile, 1 is out 2 days a week and the other is out 5 days a week. This employee that my wife has the issue with is the one who is out 5 days a week, another employee is out of the office with the doctor that goes out twice a week, and my wife is mainly in the office. Today the employee that is out 2 days a week quit and the office manager tells my wife that she is going to have to go out mobile again and that they are going to move things around and she will be going out 5 days a week and the other employee will be moved to two days a week. My wife again brought up the fact that she is breastfeeding and can't pump while on the road and nothing was mentioned again except for the fact that she has to do it. Is there some form of mis treatment here that we could take legal action on??? We have printed all of the emails back and forth pertaining to these issues and there are a few more dealing with the way my wife was treated in meetings while asking questions about their jobs.
