Consumer Law, Warranties need some advice please!

in august of 2008 i was going to buy a house, so i put 17,000 down 10,000 was to go tward the closing on the house, 5,000 was a deposit and the other 2,000 was for first months rent. i rented it untill my credit was good enough to buy it. well after a year it still wasnt good enough to buy it so i moved out because i couldent afford 2,000 a month anymore. in the contract it says i was to get 10,000 back and they keep the other 5,000 for taking it off the market. when i moved out and requested my 10,000 back they said they spent it and dident have it. so i need to know what i should do. i spoke to a lawyer here and he said it could cost me 6,000 or 7,000 dollars to fight this. i need some help cause i dont have alot of money and there must be someway to get it back. i have the contract. what can i do?:confused:
 
Well, small claims court has a $7500 limit in your state and you generally can't sue in small claims for less than your actual damages so that you can stay there.

I would pursue this with an attorney. They aren't going to fight it. Don't hire any attorney that tells you that this will be more than $2500. Further, because they spent money they were to hold in escrow, it is somewhat likely you will win attorney fees too.

No mind you the real problem is collecting from them. They are likely broke. I wouldn't let them walk away with your money though.
 
thank you very much. he says he is broke. he owns a roofing bis and doesnt have anything except maby some assets. is it possible if he doesnt have the money i could try to take something of value. also he hired a lawyer as soon as i asked for the money.
