Shoplifting, Larceny, Robbery, Theft NEED SOME ADVICE QUICK!!! Theft Charges

Well heres the deal. My girlfriend was on un supervised probation for stealing from a CVS. She was banned from CVS stores and part of her agreement is she would not get into anymore trouble and continue going to school with a seldom check of the PO coming by the school. Well she went into the same CVS and tried to steal transmission fluid.(Stupid I know please bare with me) The clerk recognized her and stopped her but she dropped her bag and ran out of the store. Then the police report was filed and a warrant brought up. She has to go speak with the prosecutor morrow about it. Now I know this is isn't very in depth description but I'm trying to find out what I can to help her. She was on un supervised probation so she gets revoked right? She doesn't have a record but has the previous theft still on her. They said they got her on video stealing and everything but she told them she wasn't really going to steal it and that it was a joke. I think she freaked out to have come up with this story but anyone have some advice on what I could start doing now to help her before she makes it worse? THANK YOU!!!!!

The only thing she should do is keep her mouth closed about anything to do with the case. she should hire an attorney or have one appointed for her by the courts. She should not speak to the DA without her attorney present. The story she gave or is going to give won't fly. Just her being there was in violation. Tell your friend to keep her mouth shut and let her attorney do all the talking for her. Good luck.
 
She should also enroll in some sort of classes to stop stealing. She may have a problem if she cant control herself from going to the same store and trying to steal something like antifreeze. Good luck.
 
Alright, so more or less she's hit I figure but i'll definatly do the attorney thing and tell her to keep her mouth shut regardless.. Are there anything that would be good to file like a motion of discovery and motion to supress? I'm sure the states picking it up since it is a probation violation for the same charge nonetheless or would anything else do her much good? I'm in the state of Indiana by the way too and thank you for advice also.
 
Does she have a drug problem? I ask that because of what she allegedly stole. I've seen this before. People steal odd things to support a drug problem. They usually take easy to conceal items, often useless nickel and dime junk.

Yea if shes not on drugs and doing it just for the thrill of it then she may want to get some help before she ends up in jail. Not to mention the record. Get your friend some help.
 
The Anti shoplifting course is excellent idea. Right now she can count on her probation being revoked and the terms of that gone. This means she will likely now have a criminal record. Jail is also a very real option at this point as well. I agree with above she needs to keep her mouth shut and talk to a Lawyer

Either way, it is a sad situation. God bless you for trying to help. I thought it was odd that she allegedly stole transmission fluid. I get it!

If I were you, I'd get her legal assistance. I'd also ask her to submit to a drug test. You might get help with that by asking her current PO! If that isn't the case, as you believe, then get her to speak with a psychologist. She needs help, if she's abusing drugs or has KLEPTO tendencies!
 
Some people steal out of necessity. Not that i justify it but I won't condemn it either. If, for example, we had a child who needed food and there was no other way to get it then what choice would a parent have?

On the other hand, there are people who steal not because they need it but for the thrill or the excitement. It is not the object that they are after. They are after the "rush".

Based on theory and my own experiences, I think the people doing this may be suffering from depression and in a misguided effort to self-medicate and feel better they steal. It probably feels better than the lack of energy and motivation that is an everyday all-day thing. The know it is wrong but they do it in spite of that. Without the challenge and risk it would be no thrill and therefore no help for the depressed person. It's obvious theft happens even when there is no necessity for it. I can't remember who it was but some fairly well known and wealthy movie star stole some things that she could easily have paid for.

I don't understand it totally but I suspect that maybe your girlfriend is looking for a cure for something else, a symptom she wishes to alleviate from her life. It would be sad if she goes to jail because she won't get treatment there.

An attorney seems wise as well as advise to "zip it".
