My husband I have rented our apartment in Florida for 15 months. Original term of lease was 12 months and we renewed last August. We have no children together but have 6 between the two of us. During a regular visitation recently, we have had a serious situation occur involving our children with regards to inappropriate physical contact. It has been a nightmare to say the least, but now the younger child involved in the situation has expressed to her dad (my husband) that she does not feel comfortable coming for visitation at our current apartment. Since we do not have any alternative locations where we can have visitation with the kids, we have decided that moving to a totally new location is the best thing for all involved. Naturally, we are concerned about breaking the lease and what effect that will have legally and to our credit, but feel that for the peace of our family and to preserve visitation with the kids, we have no choice. What are our options? This has been a very traumatic time for our family and we just want to handle everything the best way we can.

Does your lease provide any details on what specifically occurs when a tenant wishes to break a lease?

For example, some will require a rental payment of a month or two plus the security deposit. This allows the landlord time to find new tenants.

I'm assuming you're on a yearly lease, correct? If this is instead a month to month lease, the lease can be ended with a 30 day written notice on your part.
