I live in the state of CA, and I want/need to move to due the recent crime activity in my apartment complex, including a few recent shootings. When I moved in a little over a year ago it was a very quiet area, no shootings, or racial crime but within one month things have changed overnight. The complex keeps telling me that if i leave before my lease term is up on January 31,2009 then i will still be responsible for the rent amount until they can rent my apartment (currently about 20 vacant) The problem that I am finding with this is that on my rental agreement that I signed it only states that "either party can terminate this agreement with 30 day written notice" there is nothing on there, that I am able to find, indicating that i have to pay the rent for the months that I will no longer be living there. Either until the term is up or they find a new tenant. What can I do to get out of the current apartment complex without being penalized because I am fearing for my life?? Please Help ME!

Check out this link for what your state landlor/tenant laws say regarding leases. Scroll down to the leases section. As far as fearing for your safety, you need to demand from management immediate and decisive action, in writing, and if no response, then you can pursue legal action against the management company. Hope this helps!
