My Nurse Practitioner did not give me the care I needed for pneumonia. And because of her Negligence and lack of communication with her staff, she did not order any lab work, or xrays. And did not order a follow up appointment. She did Prescribe Leviquin 750mg. 1 pill a day for 7 days. On the 3rd day of taking this medication, I had severe side effects and could barely get out of bed. My fever went up. I had stomach pains. I could not sleep And I could not move my arms. Due to severe shoulder pain. I called my Doctors Office and the Receptionist told me the Doctor was not in the office. She was on vacation. I told her I was not getting better, I was getting worse. And I asked that she have the Doctors Assistant call me back. I did not receive a call back that day. The following day I called again. I told the Receptionist I needed to speak to Kathy (the doctors assistant). And she said, Kathy is very busy. The doctor is not in the office. I told you that yesterday. She cannot just stop what she is doing to come to the phone and talk to you. I told her I was not expecting her to drop what she was doing. And I told her I just want to speak to the Doctor that prescribed me this medication because that is what it says to do if I feel I might be having side effects to the Prescription that was given to me 4 days ago. I told her I was scared that I felt like I was dying. And I needed to know if I should stop taking this Medicine? She did not show me any concern for my symptoms and she said, I will give Kathy your message to return your call. I did not receive a call back. The next day, my Daughter called the office. She told the Receptionist she wanted to speak to Kathy as soon as possible. That was on Friday. Kathy returned her call within the hour. My daughter told her my condition. And asked if I should discontinue taking this Prescription? And Kathy said you need to make an appointment so you can see the doctor. She transferred the call to the Receptionist. She did not say to stop taking the Medicine. The receptionist told my daughter she could get me in 3 weeks from that day. Nov. 9th, 2017. My daughter said, that's too far away. The receptionist said that's the only opening I have. So my daughter asked to please have the doctor call as soon as she returns from vacation. On Monday, the doctor called. She said I was having Horrific side effects and to stop taking the Medication. ( I stopped taking it on Friday) She said to make an appointment for a follow up. My daughter told her I did. Its in 3 weeks. The doctor said if anything else opens up I will call you. That day I had to file for Short Term Disability. When I got the packet from Sedgewick I filled out my portion and I took the packet to my doctors office,. They wrote that I had diahrea and they sent in the packet incomplete and with the wrong diagnosis. Sedgewick called me to tell me the information was not correct and incomplete. So I called my doctors office. I told them I needed them to fill out the papers with my current condition. They sent that same information over 7xs. At one point, they used white out. And when Sedgewick called they said to file a complaint with my insurance. And they gave me the number to call. When I went in for my follow up appointment. The first thing the Assistant said to me was, you filed a complaint with our office. I told her only because Sedgewick told me too. I did not want to do that. But, because you were not giving the correct information and you used white out, they told me to file that. I did it because I did not want to lose my job. NOTE* THE DAY BEFORE MY FOLLOW UP APPOINTMENT, JUNE FRANZENS OFFICE FAXED MY WORK A RELEASE TO RETURN TO WORK. DATED NOVEMBER 8th, 2017. THEY DID NOT SEND IT TO SEDGEWICK LIKE ALL THE OTHER PAPERS. THEY SENT IT DIRECTLY TO WALMART. I WAS SCHEDUALED TO WORK THE NEXT DAY. THE NEXT DAY AT MY FOLLOW UP APPOINTMENT, KNOWONE TOLD ME I WAS RELEASED TO RETURN TO WORK??? SO EVERYDAY THAT I WAS SCHEDUALED TO WORK, WAS A NO CALL NO SHOW. UNTIL I ACCUMILATED SO MANY POINTS THAT WALMART TERMINATED ME. I LOST MY JOB BECAUSE JUNE FRANZEN SENT THAT RELEASE IN. I WAS NOT TOLD THAT I COULD RETURN TO WORK. And AFTER I LOST MY JOB. I MADE ANOTHER APPOINTMENT TO SEE JUNE. I ASKED HER WHY SHE SENT THAT AND DID NOT TELL ME? SHE SAID SHE DID NOT RELEASE ME TO RETURN TO WORK. SHE RELEASED ME FROM HER CARE. I SHOWED HER THE FORM THAT WAS SENT TO WALMART THE DAY BEFORE SHE SEEN ME. SHE YELLED AT ME AND SAID, YOU TOOK IT UPON YOURSELF TO FILE A COMPLAINT AGAINST MY OFFICE. YOU THEN WENT AND GOT A DIFFERENT DOCTOR BEFORE YOUR FOLLOW UP WITH ME. I TOLD HER THE OTHER DOCTOR I SAW WAS FOR MY ANNUAL BONE DENSITY TEST. THAT DOCTOR IS A BONE SPECIALIST. SHE CANNOT BE A PRIMARY CARE PHYSICIAN. SHE TOLD ME THAT SUMMER HAD CALLED HER AND TOLD HER I WAS IN HER OFFICE CRYING ABOUT HOW YOUR OFFICE HAD BEEN TREATING ME. AND THAT IS WHEN SHE DECIDED TO RELEASE ME FROM HER CARE. I WAS NEVER TOLD THAT SHE DID NOT WANT TO BE MY DOCTOR ANYMORE. I WAS NEVER TREATED FOR MY SHOULDER PAIN AT THE FOLLOW UP APPOINTMENT. SHE DID NOTHING TO HELP ME AT ALL. SHE DELIBERATELY SENT MY WORK THAT RELEASE AND DID NOT TELL ME. JUNE FRANZEN AND HER STAFF CAUSED ME TO GO THROUGH SEVERE SIDE EFFECTS. AND CAUSED ME TO LOSE MY JOB. THEY WERE UNPROFESSIONAL. SHE ABANDONED ME IN THE MIDDLE OF HER CARE. AND NEGLECTED TO PROVIDE ME THE CARE THAT SHE HAS GIVEN ME FOR YEARS. I TRUSTED HER WITH MY LIFE. SHE NEVER TOLD ME THAT LEVIQUIN WAS A BLACK LABEL ANTIBIOTIC THAT IS NOT PRESCRIBED UNLESS NOTHING ELSE WILL WORK. NOR DID SHE MONITOR ME BECAUSE THE MEDICATION IS NOT GOOD TO GIVE TO PATIENTS OVER 60. HER NEGLECT CAUSED ME HARDSHIP AND LOSE AND I WANT TO SUE HER FOR THE PAIN AND SUFFERING IAM GOING THRU. .IF YOU COULD PLEASE ADVISE ME IF I CAN PURSUE A LAWSUIT AGAINST HER FOR NEGLIGENCE AND ABANDONEMENT. I ALSO FEEL WALMART WRONGFULLY TERMINATED ME. ALL THE PAPERWORK THAT WAS SENT TO SEDGEWICK,( A COMPANY THAT IS SUPPOSED TO HELP ME TO GET THE BENEFITS I QUALIFY FOR) THEY WERE CALLING ME EVERYTIME THE PAPERS WERE SUBMITTED FROM MY DOCTORS. THEY COULD SEE THERE WAS A PROBLEM WITH THE WAY THE DOCTORS OFFICE WAS HANDLING THIS CASE. BUT, I HAD TO SPEAK TO A DIFFERENT PERSON EVERYTIME THEY CALLED. THEY HAVE ALL THE PAPERS AND YET THEY DID NOT SEE THAT MY DOCTOR WAS NOT GOING TO CORRECT THE CONTINUOUS ERRORS. THEY EVEN CALLED MY DOCTOR AFTER THE WHITE OUT WAS USED. AND THEY TOLD THEM THEY CANNOT USE WHITE OUT. AND THEY FAXED ANOTHER PACKET TO MY DOCTORS OFFICE. I CALLED MY DOCTOR SO MANY TIMES, THAT THEY SENT ME A LETTER SAYING TO REFRAIN FROM CALLING THEIR OFFICE. THAT IS HOW MANY TIMES THOSE PAPERS WERE SUBMITTED . HOW COME SEDGEWICK DID NOT TELL ME TO GO TO ANOTHER DOCTOR? THEY TOLD ME TO FILE A COMPLAINT? WHAT GOOD DID THAT DO? IT CAUSED MY DOCTOR TO HAVE AN ATTITUDE AND STOP TREATING ME ENTIRELY. I FEEL SEDGEWICK SHOULD HAVE DONE SOMETHING FOR ME WHEN THEY COULD NOT GET A COMPLETED PAGE IN MY SUBMITTED PACKET. SHPULDNT THEY HAVE MADE NOTES ABOUT THIS IN MY CLAIM? SO, WHEN WALMART DECIDED I HAD TO BE TERMINATED THEY COULD HAVE AT LEAST REVEIWED THE ENTIRE FILE THAT SEDGEWICK HAD . THEY SHOULD HAVE BEEN ABLE TO SEE HOW MANY TIMES THE PACKET WAS SUBMITTED. WHAT IT SAID. IF THEY RECEIVED THE RETURN TO WORK FORM? OR IF IT WAS FAXED DIRECTLY TO WALMART? WHICH IS NOT WHERE THE DOCTOR WAS SUPPOSED TO SEND ANY OF MY PAPERS. EVERYTHING WAS SENT TO SEDGEWICK. EXCEPT THAT RELEASE. HOW COULD THIS HAPPEN WITHOUT ANYONE SEEING THAT I DID NOT DESERVE TO LOSE MY JOB BECAUSE THAT RELEASE WAS SENT IN ERROR. OR DELIBERATELY? I WAS NOT RELEASED UNTIL DECEMBER 11th 2017. JACKY MEYER FILLED OUT THAT PACKET STATING MY CONDITION AND WHEN I COULD RETURN TO WORK. SO SEDGEWICK GOT THAT PACKET FROM A DIFFERENT DOCTOR THAT WAS COMPLETED CORRECTLY.THEN ON DECEMBER 12th I RETURNED TO WORK.ONLY TO BE TOLD MY 3rd DAY BACK, THAT THE POINTS THAT HAD ACCUMILATED FROM THAT RELEASE JUNE SENT, HAD ADDED UP TO 9 POINTS SO THEY TOLD ME I WAS TERMINATED. THOSE POINTS SHOULD NOT HAVE BEEN ADDED AGAINST ME. BECAUSE THAT RELEASE WAS NOT SUPPOSED TO BE SENT. I COULD NOT HAVE RETURNED TO WORK ON NOVEMBER 9th, 2017. JACKY MEYER SENT IN THE RELEASE ON DECEMBER 11TH, 2017. FROM THAT DAY FORWARD IS WHERE WALMART POINTS SYSTEM SHOULD HAVE STARTED. I WAS WRONGFULLY TERMINATED. AS WELL AS BEING ABANDONDED AND NEGLECTED BY MY DOCTOR AND HER STAFF. I HAVE RECEIVED NO MONEY SINCE OCTOBER 10TH, 2017. CAN YOU PLEASE DIRECT ME TO SOMEONE THAT CAN HELP ME? I will just say that negligence is significantly more than what you seemed to be describing. That you preferred a different treatment or outcome does not mean that they actions taken were not appropriate.
 
Does your doctor have to fill out your paperwork for short term disability? And if they do, is it acceptable to put the wrong diagnosis repeatedly? And because the paperwork was incorrect it causes you to be denied benefits and also causes you to lose your job? Is there cause enough to hold the doctor responsible?

Take your paperwork and meet wit two or three lawyers in your county.

You can ask questions, get answers, then take time to decide what you want to do, an dhow much it will cost.

The initial visit with most lawyers is free of charge.

In order to provide you a complete answer, the lawyer would need to read the documents you have related to this series of incidents.

I wouldn't get my hopes up, but you can at least get answers from attorneys licensed in your state.

How do you know it was an incorrect diagnosis? Did you see another doctor?

An incorrect diagnosis is not malpractice.
 
I had Pnemonia. She said on my papers I had Diiahrea. She kept putting that same information over 7xs. And, her staff faxed in a Release to Return to Work Form to my employer. The day before my follow up appointment? And, at my appointment, I was not told I was Released to Return to Work. ( I could not have performed my work duties. My arms would not move due to severe shoulder pain from the Leviquin that was prescribed for my pneumonia). Therefore, I ended up getting fired because I was unaware that I was schedualed for work the same day of my follow-up appointment. Everyday after that went against me, until I accumulated enough points for termination. All the other papers in the packet were sent to a different company. Why would her staff fax that release to my work? Nothing was supposed to be faxed to my employer. I was not released to return to work for another month and a half. I had to seek out another Doctor because My doctor would not treat me. She did not order any lab work. Or x-rays? She did not even schedual me for a follow-up appointment? I had to schedual it, because of the medicine she had prescribed was debilitating me. I could not get out of bed. And then my appointment was set 3 weeks away? Forcing me to file for short term disability. Which was also denied because the paperwork was incomplete and incorrect.
 
Up until this incident, my doctor treated me with excellent care. But, after she went into her own office, things changed very quickly. I do not understand why she stopped caring for me? But, I thought she had a obligation to give me the best care she could. I trusted her with my life. After I was terminated, (22 years of employment) I went to see her again. And I asked why she sent in that Release? She said she did not Release me to Return to work? She Released me from her Care? I was not aware of this. I showed her the form that was faxed to my employer and signed by her on the day before she had seen me.. She did not no that was sent? Is that not Negligence on her communication with her staff? That paper caused me to lose my job. And, she never told me she was Releasing me from her care. She just stopped doing anything for me? Doesn't she have to give me time to find another doctor?
 
Do I not have enough to sue this doctor for making me lose my job? I am 73 years old. She gave me a black labelled medication that I have never taken before. It is a last resort medicine. When nothing else will work. People over 60 should not take it. Because the side effects out weigh the benefits. Why didn't she give me the same prescription she gave me before when I had Pnemonia? And she did not even care to monitor me after I was having adverse side effects. It gave me severe shoulder pain. Stomach pain. Back pain. I could not sleep. My fever did not go down. That was on 3 days of taking it. And then they would not see me for 3 weeks?
 
The only one who can tell you if you have grounds for suit is a medical malpractice attorney who has reviewed your medical records. A message board cannot.
