I realize that my 2 years to files charges is fast approaching (December 1, 2006), but I recently found the receipt for the damages incurred and I am reconsidering going to a small claims court.
Here is what happened:
On December 1, 2006 there were high winds (up to 60mph) in the Indianapolis area. My neighbor's chimney was blown off the side of his house and it fell, punched a hole in my roof, broke a truss, and damaged my gutter. I contacted MI Homes and demanded that they pay for the damages that were incurred because they had not properly secured the chimney to the frame of the house (it was attached by FOUR NAILS, not screws). They said that they were not interested in looking into the matter and that it was an "act of God." I persisted, sent pictures, emailed, etc.
Weeks later they said that they would have possibly considered paying for the damages but, because I used a company that was not approved by them (I had to have it repaired and they said that they were not interested in the matter) and because they thought that the cost of the repairs was too high, they could do nothing except go to their managers and see if they were willing to pay a portion of the cost. After months of trying to get them to pay for the repairs, I gave up and thought that I had lost the receipt.
Now, it is almost 2 years later and I am reconsidering going to a small claims court. I paid for the repairs in-full. I made an effort to get MI Homes to pay for the repairs. They kept punting. I gave up. But I'd still like to get some justice. I have pictures of the damages, the chimney that fell off, and the handful of NAILS that were used to secure it to the frame. I also have email documentation of my conversations with MI Homes.
What should I do??? Thanks in advance!
