Please help as I am looking for some sound advice concerning an issue that is going on with my 73 year old mother. She lives in an apartment complex on the bottom floor. Her upstairs neighbor in which she used to be close to has recently turned on her this summer. Now she is older & likes to just sit outside & watch her birds & squirrels. At one point in time the upstairs neighbor would buy her a bag of peanuts each week to help her out.
The way that the decks are arranged are of course one on top of the other, my mothers is really just her front porch with his wooden deck above where she sits in her rocker. Last summer she gave him $50 to purchase a rug to help out with additional water coming through. Let me please mention that there were NO problems last year with the same plants he has being "watered" to an excessive amount.
Recently he has been waiting until she goes inside to answer the phone or use the bathroom to intentionally wet her chair so that upon her return & knowing that it is not raining just sits down to a very wet seat & table. Sometimes there seems to be wet dirt also that comes through, making yet another mess for her to clean up.
A couple of weeks ago he used a garden hose to wet her & some neighbors a couple of doors down. We believe this to be the result of his very close parking spot being moved to accommodate a handicapped woman; my mother also has a sticker however uses the second spot with ease. He has moved her stepping stones making it hard for her to fill her birdfeeder without slipping. This particular day she called me so upset I thought that she was going to have a heart attack. I called the police until I could get there. Now we all know that this would be seen as just a simple domestic disturbance, the policeman did speak with the neighbor & he was told to stop it.
This continues to happen & the management of the apartment complex has been made aware. It seems that everyone is afraid to deal with this 40+ man. He went everywhere trying to find a law or rule (as mentioned by the landlord) to make my mother remove the very same squirrel feeder he helped to fill weekly. So he finds something & the complex asked my mother to please not feed them peanuts as the shells are causing an issue. Okay she will comply with it & tells the management that she will no longer use shelled peanuts, this letter received on Thursday had no time limit noted. It rained for a couple of days so expecting to remove the peanuts on Saturday once we returned from going out. Upon returning it was noticed that the plastic piece used to hold the peanuts in the holder was "removed" only later to be found thrown in the woods.
This has gotten totally out of hand & the constant wetting of her chair pad when she goes inside is maliciously on purpose as there is no need to water any plants when we have had 2 & 3 days of rainy days. Not to mention the many times that he sticks his tongue out at her, throws items in her yard to make her bend down to get them, etc…
Please advise what my mother's rights are & what can be done to make this a better living situation for my mother? My mother was a policewoman herself & the thought of taking up their time on a daily basis just seems terrible. Can we file harassment charges on him? What proof will be required? Do we need to do surveillance or is this not legal?
Any help will be great as this is really getting out of hand.
