Neighbor Harassment

We have a neighbor next door that hates my husband and he tries to pick a fight with him every chance he gets. The last incident was a couple of Saturdays ago, my husband was outside laying sod and our neighbor walks up to where my husband is 3 feet from his face yelling profanity at him that our dog wakes him up every morning at 6 a.m to go to the bathroom. The yelling goes back and forth with the neighbor and my husband meanwhile i was sleeping and the yelling woke me up. Our dog was barking at our front door because he could hear the trouble out front. i wake up and stagger to the kitchen and open the door that leads into the garage and our dogs bolts out of the house. The neighbor is outside yelling profanity after profanity and my husband is trying to capture our dog but the neighbor would not get out of the way. At this point our dog jumps on the neighbor to push him away from my husband and the neighbor shoves the dog in a aggressive manor an the dog nips the neighbor on the knee. Now the neighbor has gotten an attorney to sue us, contact animal control to try to get our dog removed which was unsuccessful because they feel the dog felt threaten and also protecting my husband is the only reason he nip at him. We have contacted a few attorneys and they don't want to take the case. Do we have any recourse in this matter?

Yes, your recourse would be to defend yourselves, if the argumentative man sues you.

If your dog bit him, he certainly can sue. If your dog is waking up neighbors with barking early in the morning, I suggest training.
 
That's the problem we never saw the dog bite the neighbor, the neighbor said the dog did during the yelling between him and my husband. Also, about training the dog, the dog is trained. Our dog hears their McCall birds out on their screen porch early in the morning so I think any dog would bark at that. I guess that's what happens when you are sandwiched in the middle of two neighbors.... If no one saw the dog bite him - how can he prove that?

If the dog charged him, a bite is likely. He could also have a cut or mark from it. Unless your husband can testify that there was no way the dog was close enough to bite, it is going to be hard to disprove. If there are no marks or cuts, damages should be minimal.
