hi to all.my name is mike and i live in michigan.12 years ago wife and i bought propetery and installed a fense for horses.just latley the people on the oppsite side of my neighbors put up a fense and noticed the propetery markers were moved 10-20 feet on to thier own propetery.i measured mine and i am short 11 feet.before i knew of this the neighbor was putting his fense and asked if he could attach it to mine and i said yes.not knowing that he already had 11 feet of my propetery.the real bad part of this is i have installed 1500 feet of fense along that propetery line that will have to be moved over 11 feet.by the type of person he is and the things he has done i know he moved the markers, but can i prove it in a court, probabily not?is there anything i can do about it?can i get money out of him in small claims court for time and materials to redo the fense?also the marker i measured from is accurate, people had just built a house next to me( just had survey)

You need to have a surveyor come out and replace the markers. If you are correct, notify him by CRRR to remove his fence that is on your property and give him a time limit. If he does not comply, take down his fence with the least amount of damage and store the materials on his side of the line. Then you can sue him for the cost of removal but I doubt that you will be able to claim the cost of moving your own fence. You should have had it surveyed first. Take pictures of the property markers and if he moves them again go to the magistrate and swear out a warrant.

first, thanks for the quick reply,2nd what is a CRRR.and would that be thrue the township that i live in.or the state?and also my wife gave me a big helping of i told you so's,so yea, should have checked it .but we had it survey just before we bought it but he must have moved it just after the survey.(measure twice, cut once,as the carpenter says)
