My jurisdiction is: Louisiana
I am a newbie to this type of stuff, but need some advice:
We live in a restricted neighborhood that has certain restrictions filed about not being allowed to have campers, trailers, boats, etc. kept at the residence if they are visible from any street or over a perimeter fence...
The current HOA has decided that its OK to allow them as long as they are behind a fence, even if they stick up 6ft. above the fence, which the residence directly across from me indeed has....so when I look out my door and all windows on the front of my house I clearly see this white camper towering over the fence. His home is on the corner, so its visible from the front of his home and the whole side view, which is what my home faces.
Here is the restriction: "Boats, Vehicles, Campers, or Trailers of any kind or parts, or appurtenances of any boats, vehicles, campers, or trailers shall be kept or stored or repaired on any lot except in the rear of the residence and shall not be visible from any street or lake"...."such equipment shall not be kept or maintained on any lot in a manner that would detract from the appearance of the subdivision."
We built in here and spent quite a bit for the simple fact that this neighborhood does have such restrictions to keep it looking nice, plus they just increased the dues to double the amount. What leagal rights to we have with the fact that they must enforce the restrictions that are in place and cannot be selective with them? They told us that the people on the lake lots are held to a higher standard, thought. So with me not living on the Lake, does that mean that I have to look at this "trash" and that they lake lot owners won't ever have to worry about looking at campers and trailers hindering them? The restrictions don't state anywhere that a lake Lot owner has more rights, etc, and we all pay the same amount of dues?
What can I do, as a resident about them selectively enforcing the restrictions and being so discriminating to everyone who does not live on the Lake. We deserve the same rights to keep our property values from dwindling,too, right?
