In May of this year my next door neighbor decided to put a fence up while we were out of town for the week. The fence butts up against the back of my carport so I knew that he had put up part of it on my property. My boyfriends father is a licensed land surveyer and we had him come out that month and find the irons for my property lines. The neighbor was there when he was surveying it and he is aware that the fence is on my property (by 3 feet) and also the school property behind both our houses. We asked him to move the fence that day and he said he would. It is now October and he says that he has a call into his fencing company. I don't believe him at all and think that he doesn't plan on moving it at all. What should we do next? I don't really have the money for a lawyer unless absolutely necessary. Legally can we take the fence down by ourselves? There is no way I am going to give up my land to this guy. I have less than an 1/2 an acre and like I said it butts up to my carport.
