neighbors tree roots near our pool

Hi. Our neighbors tree roots constantly come under the fence into our yard. We usually get rid of them. This time they are very close to the pool and I am afraid it will do some serious damage. I want to approach them (I think they are renters) and ask them to remove the ficus tree(s) causing the constant problems. Can I do that? Legally, is it my responsibility or theirs? They do not take care of their trees. We cut back the overhand on our side to try to keep our yard cleaner. Any advice is greatly appreciated. Thanks!
 
Why not approach them? You can tell them that if they don't remove the tree, it will cause more damage to your land. As it stands, if they do not remove the tree then you might need to hire a landscaper to remove the roots on your property and which may damage the tree. The roots are on your property but there are laws and requirements in each jurisdiction that may cover handling items of this nature (typically it is with tree branch pruning.) See what they say. If they don't want to do anything I might provide written notice - in addition to the property owner, so both know they are liable.
