A bit complicated as family issues have always been.I need advice on what to do or where to start. Place: Tunisia. Issue between my uncle and my family who are next door neighbours. I live in the UK and need some wise logic to start dealing with this problem. Law may be different but a good advice knows no boundaries.
My next door neighbour ( also my uncle) after my father's death built on part of his garden taking about a meter from our own garden. Neighbour said that was a verbal agreement between my father and him. Mother agreed reluctantly as she thought she had to honour that verbal agreement which she was never aware of.
Shortly after, he expanded the first floor building to stretch out for about one meter overlooking our garden and blocking part of the view. (Thus taking now about two meters in total).
After confrontation, uncle said that if we wanted to build an extension we could use his wall ( which is now on our land) and that we were family!
This looks like it is getting too complicated and messy.
Question: What is the best course of action as this will affect any future plans to sell the house or want to actually build an extension?
Our desire is to stop this mess in a wise way as not to create any further tension. What to do if we decided to claim that piece of garden back?
Your help would be most appreciated as this " is turning into vinegar" as the French say.
Thank you for your priceless advice.
