I wanted to ask any who could contribute about this situation. Its a bit of a story.
My parents divorced back in 1970 with four children ages 7, 10, 14 and 16.
My father payed the mortgage on the house for maybe two years until they agreed to sell it and he took his share minus the child support he was in arrears ( two years worth) and then left the state of NJ for florida. We virtually never saw him nor another nickel of child support again.
In those days it seems you couldnt pursue someone out of state on a deadbeat dad charge.
Now after all these years of estrangment by his entire side of the family, meaning we heard not a word from his entire clan in the many decades since his disappearance, through the odd circumstance of spotting an obituary, I have found all that is left of them.
Apparently my father died intestate thirteen years ago, had some means, particulalry a house that he shared with his second wife, and I dont really know what else. She never made any attempt to notify any of his four lineal (sp) decendants.
My aunt tells me about some arguing that broke out between the wife and some family members over the idea of finding my fathers biological kids to notify them that their father had passed away, but she refused. We would not have been hard to find.
Sorry for the long story, my question is, do we have any recourse over recovering our share of his assets at this late date. The wife is alive and well. It would seem only right.
