My husband and I purchased a new Wrangler Unlimited on Sunday. We agreed to the purchase price and trade in value of our Liberty. The contract we signed was for a specific VIN # that was to be shipped from another in-state lot. They took our trade-in on site and gave us a rental to drive until the new car was delivered. We were contacted on Wednesday and told that the lot that was supposed to send our car over had sold it to another party. Therefore the contract was void because the VIN # was no longer available. We returned to the lot and picked up our trade in and decided to shop elsewhere. We were very jaded over some issues that had occured before this information so we were glad we were able to walk away. However, we recieved another call from the GM on Thursday. He told us that the car we had intended to buy was available again because the financing had fallen through on the interim sale. He informed us that we were legally under contract for that VIN number. It is infuriating that they are threatening to hold us to contract after they said the car was sold and returned our trade-in to us, but is he right? Do we have any consumer protection rights under this scenerio or are we still legally bound to this contract??

No, when they told you the car had been sold, they voided the contract not you.

You don't have a contract anymore!
