Next of Kin?

My sons father passed away unexpectedly on Saturday and he had no will. He has no spouse but he does have a total of 3 children. One being my son who will be 10 next month and a 2 year old and 3 year old that he had with his fiance(they were to get married next month). The problem that is occuring is that my son and the fiance want to have him buried and the parents are fighting us to have him cremated. The funeral home is going with the parents and there is a cremation scheduled. So, I guess what I am trying to find out is who is the next of kin and is there anyway that I can stop the cremation and have my sons wishes for what he wants to happen with his father fulfilled?

Are you and the finace willing to pay for the burial?

Yes. We have told the parents at the very beginning of all of this that we would pay for the funeral. The only reason why the mother and my sons uncle want to cremate him is because it is cheaper.
