Shoplifting, Larceny, Robbery, Theft NH 16 yr old shoplifting punishment?

NH 16 year old shoplifting
Son participated in a diversion in January of this year so diversion is not possible. He left a store with a $20. hat without paying. He was approached outside the building by someone as he took the hat out of his shirt and was asked if he paid for it. He said no and went inside with the employee, apologized and offered to pay for it. The police were called. He was charged with a misdemeanor. Court has not yet been scheduled. Should we get an attorney? Should we sign him up for a course that teaches about shoplifting intervention? what should he expect as a punishment from the court?

I take it the court can look at his diversion, should we mention it? Thank you.

Should you get him an Attorney? YES! Should he take an Anti Shoplifting course? In my opinion yes as he clearly did not learn anything first time. I know of such a program and have contacts within this group NASP (National Association for Shoplifting Prevention). Send me a PM and I will give you the email to the course we recommend. His punsihment could be severe as Judges frown on repeat offenders. Taking this course, previously mentioned, might be of great help
