Shoplifting, Larceny, Robbery, Theft NJ- 3rd Degree Felony

I am 25 years old. I was caught stealing. $540.00 worth of stuff (two Items).

I have questions.

1. If you have stole before in the state of NJ what was the outcome in the end? This is my first time.

2. I was banned from the store. OK. Fine. The guy said he saw me steal before. He didn't write that on the police report. What are the chances he tries to come after me with the pervious case? Since, he did not state it on the police report, I feel that its low. Do you agree?

3. Could the LPs (Loss Prevention) share my picture and information with the other stores in the same mall? If Yes, have you heard it being done?

As you are well aware this is a felony charge. any of our users who might have stolen would have to have been charged with felonies to compare to your case

Can't say if this person has evidence of any prior thefts he could provide DA with that evidence and additional charges could be applied

Yes it happens quite often
 
I find that odd that they can legally share your photo and information with a different retailer in the same mall.

- If they took the two items back, and called the police and I was charged. Do I still have to pay restitution?
- Also, if they did share my photo, or if they did really see me steal before. When would I find out if I was being charged with more then (1) count?
 
What law prevents a retailer from sharing with other retailers who the thiefs are? mall stores are tight nit group and many share info with both other stores and mall Security. If you get a letter of civl demand I suggest paying it. When an dif you get additional counts will depend on DA when an dif he gets additional evidence of prior thefts. He (The DA) could hold the additional charges over your head as bargainning chip for plea deal. Simply put your in very very hot water and prison is an option. You need to start calling Lawyers right away and formulate a defense plan

Not only can they legally share your photo with other stores/security in the mall, it goes into a company database where all the company stores can see your picture and information. They can take your picture, blow it up and put it in their store along with your information....as long as what they post is true, they are legally covered.

Did you damage the items? If not, no restitution is needed. You will however have to pay a Civil Demand fine. It is usually 2-3 times the amount of merchandise stolen with a minimum amount and a maximum amount. You can make payment arrangements.

You would find out when the courts mailed you a notice, and/or if you ever came in contact with a police officer and you had active warrants. The easiest way is to go to your states judicial website and search your name or call the courts
