Hello,
I was involved in an auto accident where i was driving intoxicated and hit a telephone pole. My car was the only auto involved, and my girlfriend was in the car with me. I faced a third degree aggravated assault charge in the county court due to my intoxication, which i pled guilty to under the condition that i am admitted into pre-trial intervention (basically probation) for one year (ending this november).

1) The conditions of my probation are 50 hours of community service.
2) I must maintain gainful employment.
3) I must attend a defensive driving course.
4) I must attend an alcohol rehab facility.
5) I will keep my licence.

Now that i am currently serving my probation, i have recieved a summons in the mail to appear in municipal court for dwi for the same incident. If i am convicted of a dwi, i will loose my job, thereby violating condition 2, as well as condition 5.

Will this force the dwi charge to be postponed until after my pti completion so as not to violate the county judges orders? If i complete pti, can the municipal dwi charge still be prosecuted?

If non of this is possible, can i request that the dwi charge be adjourned until i complete pti? This way I won't violate my probation, and can find a new job after pti is complete and i loose my licence.

GENERALLY a subsequent charge out of the SAME incident will not result in a violation of probation.

But don't listen to me.

Ask your probation officer.
