Child support ex-parte order of 2005, huge arrears. Father (non-custodial) left US in 2003, works in home country & sends some money or gifts as & when possible. Mother is a resident, not a citizen, worked in NJ till 2008 and now studying. Both parents NEVER bothered to check the order or arrears. Son is nine yrs and often talks to father. There is no present situation of revenge or enforcement between parents. They have not divorced. Father can't afford to pay off arrears. He has so far sent more than half the arrears but directly, not through support agency
Both parents want to check 2 things - a) how to annul or revoke both the order and arrears; b) whether there is any warrant or if father's entry to US will be flagged. Mother fears that the case is beyond her control now.
Local family court suggested over phone to father that mother can send a letter to "cancel order & reverse arrears". Does it work that way?
Should father, who stays in home country, enquire with US embassy there? He was given a 10 yr visitor visa in 2005 when he visited son briefly. How to check if that visa is valid?
One workaround for father to get a new passport made so that he can enter US, meet mother and son and they can figure out what to do next.
Would an attorney be able to check the above 2 things?
