No Administration necessary

My grandfather died 6 months ago, His wife passed away 2 years ago, they had 2 sons my father passed away 5 years ago. I assumed there was a will, when I called the probate court where he died, they informed me he had no will, they said there was a petition in process. I looked in their local paper and found my Uncle Was petioning the court for No administration necessary, after pulling this form up online I decided I must not be listed as an heir since I had not received or signed any paper, When we called back they informed us I was noy listed as an heir, and I should get a lawyer. When I spoke with my uncle he acted as everything was left to him. I hated to think he could do this, but the form clearly ask him about other heirs, (his deceased brother living children) I will find a lawyer Tuesday, because the petition said on or before September 8th. My question is what is the process once I've obtained a lawyer. And what advise could you give me. Thanks in advance for any help in this matter
 
I think you would have to waive your rights or be cited before he could succeed on the "no administration." Your attorney will know what to do, but your father's kids are supposed to receive half. So for example, if you had a brother, and the estate was 100 thousand dollars, then your uncle would get 50 thousand and you and your brother would receive 25. If you are an only child then you should be splitting it evenly with your uncle.
