Alcohol & Drugs: DUI, DWI No Driving? How long?

I recently was arrested for a DUI in oregon and refused to take the breath test. The charge states that I will loose my license for one year. However this is my first DUI so I am eligble for diversion which means I only loose my license for three months. Is there a chance that the failure to comply my be void?
