Hi,
Would be great if somebody could help me out of this.

I rent an apartment from a prominent Apartment group in Arlington, Virginia. I previously had a rental agreement for 6 months in 2006 in one apartment. I didn't renew my lease after 6 months as I had to leave the country for 2 months.

After I came back in January 2007, I started living in a new apartment in the same building and I did not sign any lease agreement as the deal was done orally and because I knew the lady in the office. Today, I want to get out of the lease, because of my new job location.

My questions are:
1) Will a contract be implied because of my monthly rent payment?
2)Should I give any notice to the apartment group? The genral notice period wih this grp is 2 months, but, I cannot afford to give that notice because of my work committments.

Please advise. Any reply is greatly appreciated.

Sounds like you have a month to month tenancy; but we'd have to see the lease in case it said something like the terms carrying over if it was ever a month to month tenancy.

Thank you Seniorjudge.

But, since i moved into a new apartment whoel together..it was like I had to enter a new lease...yes, the priginal lease if I had signed implies a month to month lease. Now, assuming that clause would oreate, woudl a one month notice suffice?

If I were under a lease and had to break my lease, then, I would have to give them a 2 month notice and pay 2 months rent for breaking the lease.

But, I can afford to give them 1.6months notice and I don't want to pay them anything. Is this possible?

Without having the lease to read, I can't answer your questions.

So, negotiate with your landlord.
