My jurisdiction is: texas, harris county

My grandmother passed away well over ten years ago leaving no will. She had 4 children, 3 girls and 1 boy. the youngest girl of the 4 has been living in the house , she made it impossible for anyone else to do so, after my grandmothers death she has greedily guarded the house like a mad dog . Hurricane Ike came and left a great big cottenwood tree in the middle of the roof demolishing the house. She claims that fema will not fix it unless the other siblings sign a quit claim deed. she got a lawyer which drew up papers for my mother to sign.. in the quit claim it is asking my mother to sign away all of her rights and her heirs rights. my mother is very upset over this and doesnt want to because my aunt has no heirs or children of her own. I am a potential heir ., my mother is on anti-psychotic medication due to a history of mental illness.is it legal for my aunt to do this , expecting to eliminate all other heirs when she herself has no children? she constantly screams and throws fits and im afraid she will get my mother to sign a quit claim deed only because my mother fears her and doesnt like to argue. my question is if my mother signs can me and my sister contest it. my mother has no money for a lawyer and neither do i so any advice on this matter will be greatly appreciated. i think the only way my mother would sign is under duress .

And none of the siblings has brought an application to have the grandmother's estate divided under the intestate laws? Whose name is on the deed to the house?

What does your aunt's lack of children have to do with this? Your mother should be upset about this because your aunt is attempting to steal her - not because of your aunt's lack of heirs.

To what? The house? Not as it currently stands. The grandmother's estate most likely belongs equally to her children.

Sure. It's legal so long as everyone else agrees to it freely.

Possibly. A document signed under duress, or if the signatory is incompetent, may be invalid. You should seek the advice of a lawyer.
