no written contratct

builder never gave written estimate after several prompts to do so and now is asking about 1500. more. Where do I stand in small claims court with no written agreement and job running over by 3 months than should have taken?
 
I have to wonder why would you allow someone to start building something for you and have no estimates as to the cost of the project?
You are going to wind up with a sittuation of "he said, she said"
Verbal and implied contracts are not a way to do business when you are talking about thousands of dollars, and your contractor knows this.
I think you need to take a new approach on this and sit down with your builder in a calm manner and see if you and he can find some middle ground......Then get a contract on that agreement and move forward.

Gary, you are correct. Bottom line friend of a friend, not how I will do business again. I did come to an agreement last evening on price and I can live with it just to see this wrapped up although it will be another month. I however am not happy with quality of some of the work and thus starts round two. I got a quick exterior paint job and I quess he thinks if it looks "pretty" I would be content. Not so. If this battle can not be resolved do I have any recourse in court at all.

Not having a contract gives you no gurentee on anything. I am happy you guys came to an agreement on the price. Maybe you need to let him know that the job is not comming out as well as you expected, but because he is a friend try to work with him in a fair manner to get it right.........even if you need to grab a brush and help.
Atleast when the job is done you will be hradache free.....

theres a will in a box at a bank its been there almost a year the lady that wrote the will passed away almost a year her grand daughter has power of attorney over her legal affairs there is a will that says the granddaughter is execuator over her legal papers what happenes after the year is up what happens then if she refuses to take the papers out of the box and have the will probated
