My jurisdiction is: New Jersey although the online auction company is based out of Washington D.C.
I work for a very small company in New Jersey and we recently made a purchase via online auction. We won the auction for the sum of $1500. I then paid for the product and was told that I would receive my product within six business days. It has now been ten business days and still continue to get the run around from the company. To top all of this off, I saw that the auction with the goods that I had won was relisted and was resold to the sum of $3650, while they still had my money for the product. I have tried in every which way to receive my product even offering to pay extra in order for them to let me pick it up. I am not the best with law, but I did some research and the site claims that the seller has an irrevocable right to deliver the product. Meaning that there is no reserve price. I would not care if they had given me my money back before relisting, but they did not. Is there any recourse that I can take to try to either get my product or receive money for lost profits off of non-delivery of goods. I plan on filing with the better business bureau and the Federal Trade Commission. I am looking for any other places to file or what may be my best course of action to recuperate lost profits. Any help that I could receive would be great. Thanks
