Hi, I recently auctioned a car on ebay with the option of a buy it now price. With in the last 24hrs a bidder entered a bid then decided to buy it now rather than risk losing the item, this also stopped anyone else raising the bid.
The highest bid prior to his was £3700, and he won with buying it now for £4500.
The problem is the winner bidder contacted me 48hrs later stating they could no longer raise the funds to pay for the item.
Should I offer the car to the next higher bidder as part of ebay's seocnd chance offer system, I stand to lose £800.
My question is can I go to small claims to try to recover the full £4500 and pass on the car to them or if I chose to sell the car to the next highest bidder can I claim for the loss of £800?

Any quick response is appreicated as I dont want to drag this out and need to know whether I am wasting my time with the whole thing.
Many thanks.

It sounds like the buyer broke an agreeement to buy the car, so yes you can terchnically sue him.

If you are in the UK I am not sure what the laws are on small claims there, but you would probably have to file in the area where the buyer lives. So whether or not it is worth it for you to file that is up to you.
