Dear TheLaw.com,
Thank you for making it simple to get help!
I am one of three roommates. I have a verbally agreed sublease with roomie #1, who is the only one on the lease. Roomie #2 also has verbally agreed sublease. The landlord is aware of this, and is unconcerned. He expects #1 to pay him, period. He does not interact with #2 or me (#3).
#2 has never paid #1 even close to what he agreed to pay monthly. Let alone utilities. He does not contribute to household supplies or food. He spends only a few nights a week at the house, but has managed to fill every storage area including the garage to the brim with his tons of belongings. He eats our food and is a filthy pig. This house is 8 months old and #1 plans to buy it at the end of his one year lease.
Regardless of the fact that #1 has been very lenient(they were best friends til this situation), can #1 evict #2? #1 and myself, (#3), are financially scrambling to make ends meet because of this. #1 is taking most of the financial hardship. (by choice in regard to me).
Please advise us as to what to do and where to start. #2 is just taking advantage of #1's kind nature. #3 (me) stays out of it mostly, except to be a sounding board for #1.
Thank you for your time, SheGotIt
