non-renewal of lease

Earlier this month (May), I offered a new lease to an existing tenant. Her current lease expires at the end of June. She agreed and returned it, but with changes. She crossed out the clause that advises her she must vacate upon 60 days notice from me. She has done this in the past and I have agreed to it up to now.

I do not intend to agree to the change and have not returned an executed copy of the lease to her. To date she has refused to sign a lease without this change.

Must I offer her a new lease (she is a senior citizen)? Does her lease revert to a month-to-month arrangement after that? How is the month to month arrangement affected by the pre-existing lease without the clause? When may I give her a 30 day notice of non-renewal?

Either you are offering a FIXED TERM LEASE which unless a breach happens cannot be terminated until it expires by either party OR you are offering a MTM agreement that CAN be terminated by either party with whatever notice is agreed to or mandated by your state.

You are trying to invoke an agreement that is both and judges frown on that.

Florida also has different notice requirements that perhaps you should review...
