not enough money to get an attorney, In need of help!!

My ex has primary custody of our child... a little over a week ago he posted a suicide note on a social profile... his wife wants to leave him... they have a child and she has her own child from another marriage. since he posted the note our son has been with me since and I have not given him back due to his issues, he agreed that it was better for our son to be with me, I told him that at the moment he can come visit but not take our child. he doesn't like it but agreed, now he is feeling better and is accusing his wife of being on methamphetamines, this is a drug she did use in the past but has been clean for a few years now, i do not believe this to be true at all, I feel like he is trying to do to her what he did to me in court... I have been told that I could get sole custody since I have a paper trail and this suicide note is not the first, he did it with me and with his ex girlfriend... i can't afford an attorney and I don't want to mess this up... as of now he is talking to me and telling me too much and he now has a Gun because he believe his wife's guy friend want to hurt him, its a big fat crazy mess, I called a mental hospital and explained whats going on and they think he is delusional, i agree. I have told him that he will not get to have unsupervised visitation until he gets some professional help but now he is so bent on destroying is wife that he has forgotten he has a problem... does anyone have advice on what papers to file in order to make his supervised visitation legal and not allow them to go away until he gets the help he needs... Thank you
 
You called a hospital and "they" told you that "he was delusional" without him being a patient? I find that difficult to believe - since they would blatantly be acting unethically in doing so (and if he was a patient they'd likely be breaking the law).

You can try to file an ex parte (emergency) motion but frankly I'm not seeing PROOF (a Facebook update is not proof) of anything, and the child isn't in immediate danger.

So, you might simply want to file for custody.

Be prepared for Dad to change his mind immediately and demand the return of your son...which you will have to do.

Currently you do not have the right to withhold the child from him - and you don't have the right to demand his visitation is supervised. You could get into serious trouble in court for that, if Dad wanted to make an issue of it.
