Not sure where to put Abandonment

3 years ago, l had to flee my home to get back to Canada because my husband in the USA based on his lawyer, the police and the VA representative, all telling me my life was in danger due to my husband's mood and what he might do and that was snap. l had a matter of min. to get clothes out of a window and leave telling him l was going to take the cat and dog to the vet's office.
l left Tennessee and never looked back. My husband tried every which way to get me to just cross over the border and based on the Canadian police, they said not to talk to him, no more communication and whatever l did not to cross the border.
My husband then hired someone to come and find me where l was living at my Mother's and where l worked. l then went to the Police who warned this man to stay away from me and leave me be. l never pressed any charges.

l moved away and started my life over again and for now l have not been found and it is going into year number 4.

What l would like to know is the abandonment of marriage act, does that mean after 7 yrs of not being down south, our marriage is over as it clearly shows that neither of us are together anymore so we don't need to get a divorce???
 
In the US, you will have to file for a divorce in order to be legally divorced. Separation of 3, or even 30, years does not terminate a marriage without going through the court process. I'm not sure about Canadian law.

The separation and his threats (I assume he threatened you) are probably sufficient grounds. The following, from your other thread, may or may not help you. Retaining a lawyer is a good idea.

Another thing my American husband did was not be upfront about his past to me that l later found out from his daughter just before l left for good. He had a record for molesting his daughter and stepdaughter when they were young until they were teenagers. That to me explained why he was permanently impotent and was not able to consumate the marriage at all for the 2 yrs it lasted. l am hoping telling that to a lawyer here in Canada can help me.
