First off thank you advance for reading my post. While I was in college I was arrested for shoplifting (155.25) in Nassau County, NY over 10 years ago. I was 20 years old at the time. I hired a attorney and was convicted of a disordely conduct 240.20(7) and paid a fine. I am considering applying for the NYPD and while browsing their website for factors that would be cause for disqualification it states that conviction of petit larceny would be grounds for disqualification. In my opinion, I wouldn't be barred from the NYPD because I was convicted of a violation. I just wanted some expert opinion on this. Also, I dont know if this is even possible but can and should I get this expunged? This was my first and only run in with the law. In, addition while I have your attention. What should I put down on job applications when they ask if I have ever been convicted of a crime? Thanks again.

I forgot to also mention that my attorney sent me a certificate of release from civil disabilities to be notoraized and then filed with the court. I was immature back then and disregarded it. What exactly is this certificate and is it too late to send it to the court since its been over 10 years?

If you have not expunged it, you have been convicted (infraction…….small crime like speeding ticket), but your background check would show you plead guilty to a lesser charge. So technically you were convicted. Some contend disorderly conduct is not a crime and just a ticket……..it is true but the case disposition would show traces of larceny(since you were charged one thing and convicted of another……….I am guess you had a plea deal let me know if I am wrong). Apart of working for NYPD, if you expunged it, you don't have to say you were convicted. Expunging gets rid of the info and so you pretend it never happened. You have to be honest with NYPD because they would run your record via FBI which does not expunge records. NYPD would require you to provide info even on expunged records. You should check with your state law on the type of charges which can be expunged……………it varies from state to state. You can call a local criminal attorney for free consultation to see if it could be expunged. Disorderly conduct is an infraction…….small crime. It generally does not affect people getting jobs. What affects people are convictions on crimes of moral turpitude like larceny.
