NYC Maintenance Issues

Hello,

I need some advice if I should take this problem further.

The building I live in, in Brooklyn, NY has been experiencing deficient maintenance and cleaning over the past couple of years. On Friday, May 8th, a tenant left a giant mountain of garbage in the incinerator room on my floor. It stayed there until May 10th when the porter finally picked it up. It was absolutely horrendous. And it stank like you wouldn't believe. I took a few photos of it, and sent it to the Managing Agent of the building. This is not the first time something like this happened. Last time, it lasted for five days. Garbage like this is supposed to be put in the basement.

The Managing Agent sent me back a letter saying that I am making all kinds of allegations - that I allege this, and I allege that, even though I sent proof in the form of photos. She said that the porter assured her that there was never anything in the incinerator room at all! She also told me that if I knew the identity of the tenant dumping garbage, I should tell them how to dispose of their refuse.

In my letter, I also mentioned that the Hallways have not been painted in 15 years and all of this is adding up to be an unsanitary environment. She further stated that my comment about the hallways is "invalid."

I wrote a second letter with pictures of the hallways since the walls are now covered with dirt. Perhaps they're not aware of it?? Another tenant anonymously passed around a petition to get the walls painted which resulted in no action.

The city (HPD) sent an inspector to look at the hallways and issued the landlord a violation to paint all walls and ceilings on all floors. So far, no work has been done except for the slopping of some plaster splotches here and there and now it looks even worse. I'm sure the landlord / Managing Agent certified that the painting is all complete.

So, after my second letter, I don't know if I did the right thing or if I should just forget about it, or maybe take it further. I can file for a rent reduction due to a reduction of building-wide services. But I'd rather have the paint job which we don't seem to be getting anytime soon.

It wasn't like this when I first moved in to the building but it's kind of sad to see what is happening. Hope my letters don't spark retaliation.

Hi Gail,

Yes, I have called HPD (the inspection department) to try and get them to reinspect the building. It's very difficult getting an answer from them. The other alternative is to file a new complaint for the same thing. If I can't get an answer on the current violation, I may have to start the process all over again. LL won't be happy with it of course...but what else to do?

I work for a public housing agency in NYC and I know that this kind of condition wouldn't be tolerable in a housing project - the tenants would be calling their city councilpersons, etc. to correct the condition.

Perhaps that is what I need to do???
 
Yes; I agree that is what you need to do.

It would seem that the requests/demands from the tenants fall on the deaf ears of the landlord.

Being fined for not meeting these requirements after an inspection might cause the landlord to perk up a bit.
