NYC Speeding ticket

Yesterday I was issued a speeding ticket for driving 42 mph on 30 mph zone and I am planning to dispute this ticket for the following reasons:

1. I dont think I was doing 42 mph.. I had just turn right after the light and I was just a block away from the light when I was pulled over..I drive a Van and it does not have that kind of pick up.

2. Body type is incorrect on the ticket.. it says SEDAN whereas I was driving a VAN

3. Ticket states I am the owner of the vehilce whereas on the registration its my brother name.

Please advise if I should dispute this ticket or not.

You can dispute the ticket but I can't say you'll win. Stating you don't think you were going 42 won't help you any. Regarding the body type, I can't be sure what the options were and that itself may not be fatal. Regarding ownership of the vehicle, I'm not sure this is fatal either although I'd argue points 2 and 3. It doesn't hurt to go into court and claim the above but the most important are dealing with the facts of the offense, attacking the "prima facie" case or the elements that make up the prosecution's case. If you can attack those, the case is over. Most attack the ability to track the radar, incorrect info about the driver, incorrect charge, inability to plead the elements necessary for the charge/offense.
