Help,
I need some advice. I am live in New Zealand (I am a NZ Citizen), I married an American in FL USA, we came to NZ, we had a child (born in NZ/ is a Citz of NZ and USA) and I endured emotional and physical abuse for 4 years. He went back to the US after his request for immigraiton failed. It failed based on his character. He was red flagged at NZ Immigration with concerns and is not allowed to enter NZ without applying for a special direction and special visitor visa... which will probably fail based on his background regardless.
I have lodged a police report which contains photographic and recorded evidence of the abuse I endured. If he made it back here, charges will be laid. He was abusive in past relationships to both partner and kids.
I want to get a divorce from him but I dont think he will let me have one because he doesnt want to loose his daughter. He has made no support to her in the 2 years he has been away.
I have my own assets that were mine prior to us meeting and marrying (including a house w/ mortgage) but I did not get a pre-nup.
What is likely to happen if I want a divorce, what will I have to go through? He is currently unemployed and has been for marjority of the time since he was back in the US. We have not seen him since he left though I have made the odd call and email to know where he is at.
Is it worth just leaving this alone and just stay separated until he is ready?
